Ordering and Payment Terms

Payment Default

For invoice payments exceeding $5,000, a 3% credit card processing fee will apply. Customers may avoid this fee by paying via ACH, wire transfer, or check. This policy helps offset the high transaction fees imposed by credit card processors on large payments.

Shipping and Delivery

Shipping Methods

Abernethy Beck, Inc. offers a variety of shipping options to accommodate our customers' needs. Laser systems and Donaldson BOFA fume extraction systems are typically shipped freight. For smaller parts and accessories ordered through our e-commerce platform, we generally use UPS, with shipping costs calculated at checkout. Unless otherwise specified by the customer, Abernethy Beck, Inc. will select the freight or shipping company at its discretion. Shipping dates provided are estimates only and are not guaranteed. Customers will receive tracking information once their order has been shipped.

Shipping Costs

Shipping charges are applied at checkout and cover standard packaging and delivery. Customers are responsible for all shipping costs unless otherwise stated at the time of purchase. Shipping rates may vary by order and are subject to change without notice.

Delivery Timeline

Delivery times may vary depending on the shipping method chosen and the destination. While we strive to meet estimated delivery dates, we are not responsible for delays caused by carriers, customs clearance processes, or other unforeseen circumstances.

Risk of Loss

All products are shipped FOB (Free on Board) origin, meaning that the risk of loss and title for such products passes to the customer upon delivery to the carrier. Abernethy Beck, Inc. is not responsible for lost or damaged packages once the carrier takes possession. Customers who wish to add shipping insurance should contact us prior to shipment to arrange for this service.

International Shipping

For international orders, customers are responsible for ensuring that the products can be lawfully imported to their destination country. Abernethy Beck, Inc. is not responsible for any customs restrictions, tariffs, or other regulations that may apply.

If a shipment is returned to Abernethy Beck, Inc. due to the inability to clear customs or for any other reason beyond our control, the customer will be responsible for return shipping costs and any additional fees incurred.

Inspection Upon Delivery

Customers are required to inspect all products upon delivery and report any damage or discrepancies within seven (7) days. Failure to do so may result in the denial of replacement or refund requests.

Returns and Refunds

Return Policy

Abernethy Beck, Inc. offers a 30-day return policy for most products. To be eligible for a return, items must be in the same condition as received, unused, and in their original packaging, along with a receipt or proof of purchase. Returns are subject to the following conditions:

Restocking Fees: A restocking fee of 25% applies to all Donaldson BOFA replacement filters and Universal Laser Systems parts. For other items, a restocking fee may apply at Abernethy Beck, Inc.'s discretion.

Non-Returnable Items: Custom orders, Universal Laser Systems, Donaldson BOFA fume extraction systems, and Universal Laser Systems laser sources (new and refurbished) are non-returnable unless defective.

Electrical and Electronic Components: All electrical and electronic components — including but not limited to laser cartridges, laser sources (new and refurbished), RF power supplies, control boards, motherboards, motor drives, power supply units, sensors, wiring harnesses, and any circuit-board-level assemblies — are non-returnable once shipped, whether installed or uninstalled. Due to the risk of latent damage from machine faults, electrostatic discharge, voltage irregularities, or improper installation, Abernethy Beck, Inc. cannot resell these components after they have left our facility. Defective items are covered under the applicable manufacturer or ABI warranty and will be evaluated on a case-by-case basis.

How to Initiate a Return

To start a return, customers must contact Abernethy Beck, Inc. at info@abernethybeck.com or call our customer service line. Items sent back without prior authorization will not be accepted.

Refunds

Once a return is received and inspected, Abernethy Beck, Inc. will notify the customer of the refund status. Approved refunds will be issued to the original payment method within 10 business days. Refunds may take additional time to process depending on the customer's financial institution.

Damaged or Defective Items

Customers should inspect all deliveries upon receipt. If an item is damaged, defective, or incorrect, customers must notify Abernethy Beck, Inc. within seven (7) days of delivery to arrange for a replacement or refund.

Warranty and Support

Warranty Coverage

Limitation of Liability

To the fullest extent permitted by law, Abernethy Beck, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, revenue, or data, arising out of or related to the use of our products or services, even if we have been advised of the possibility of such damages.

Maximum Liability

Abernethy Beck, Inc.'s total liability for any claims arising out of or relating to our products or services shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

Dispute Resolution

Mandatory Arbitration

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction for disputes regarding intellectual property rights or breach of confidentiality obligations. Additionally, disputes involving claims under $5,000 may be resolved in small claims court.

Arbitration Costs

Each party shall bear its own costs and expenses arising from arbitration, including attorney's fees, unless otherwise awarded by the arbitrator. The cost of the arbitrator's fees shall be shared equally unless the arbitrator determines otherwise.

Governing Law

Choice of Law

These Terms of Service and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.

Venue

The parties agree that any legal action or proceeding arising out of these Terms of Service that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina. The parties hereby waive any objection to personal jurisdiction or venue in these courts.

Time Limitations

Abernethy Beck, Inc. shall not be held liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, labor strikes, supply chain disruptions, war, terrorism, or any other event that makes performance impossible or impractical.

In the event of a force majeure, Abernethy Beck, Inc. will make reasonable efforts to notify affected customers and resume performance as soon as feasible. Customers may not hold Abernethy Beck, Inc. liable for delays or non-performance resulting from such events.

Intellectual Property

All content included on the Abernethy Beck, Inc. website, including but not limited to text, graphics, logos, images, product descriptions, software, and any other materials, is the property of Abernethy Beck, Inc. or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

Customers and visitors are granted a limited, non-exclusive, non-transferable license to access and use the website and its content solely for personal, non-commercial purposes. Refunds: Refunds for eligible items will be processed to the original payment method within 10 business days after the return is received and inspected.

Non-Refundable Items: Custom orders, digital downloads, and items marked as final sale are not eligible for refunds unless defective.

Damaged or Defective Items: Customers must report damaged or defective items within seven (7) days of receipt for a replacement or refund, as applicable. Supporting documentation, such as photographs, may be required.

Exclusions from Complimentary Support

The following services are not included in complimentary technical support and will incur additional fees, including any training sessions:

All training sessions will incur a fee unless otherwise agreed upon by Abernethy Beck, Inc.
Support for issues caused by unauthorized modifications, misuse, or negligence.
Repairs or replacements for damages outside the scope of warranty coverage.

Third-Party Software and Systems

Support for third-party software or systems, such as EZCAD or LightBurn, is limited to integration with ABI products. Customers requiring in-depth assistance with third-party software must contact the respective software providers.

Customer Responsibilities

To facilitate efficient support, customers are expected to:

1. Scope of Prohibited Disparagement

Disparagement includes any statement, whether written or oral, that could negatively impact ABI's reputation, goodwill, or business operations. Constructive criticism provided directly to ABI through private communication is encouraged and not considered disparagement. Truthful and constructive feedback aimed at improving ABI's products and services is welcome when communicated directly.

2. Exceptions

This clause does not restrict customers from making lawful complaints, reporting violations to regulatory authorities, or engaging in whistleblowing activities as protected by applicable law.

3. Resolution Process

Customers are encouraged to address grievances by:

4. Breach of Agreement

Recovering damages caused by the breach.

Product Availability and Discontinuation

In the event that a product is discontinued, Abernethy Beck, Inc. will make reasonable efforts to provide a suitable substitute or alternative solution. However, we do not guarantee the continued availability of any product or part. Electronic Communications Consent

Survival Clause

The provisions of this agreement that by their nature should survive termination or expiration, including but not limited to Limitation of Liability, Indemnification, Intellectual Property Rights, Non-Disparagement, Governing Law, and Dispute Resolution, shall remain in effect after the termination of the customer's relationship with Abernethy Beck, Inc. or the cessation of services.

These terms ensure continued protection and enforceability of rights and obligations critical to the operations and reputation of Abernethy Beck, Inc.
